Terms of Service
These Terms of Service (“Terms”) govern your use of the website at graftedrootsfarms.com and all services, products, memberships, and content offered by Grafted Roots Farms LLC (“we,” “us,” or “the Farm”). By using the site or purchasing from us, you agree to these Terms.
1. About Us
Grafted Roots Farms LLC is a Massachusetts-based agricultural business operating at the historic Chestnut Hill Farm, a 250-acre property under the stewardship of The Trustees of Reservations. We grow specialty produce, gourmet mushrooms, microgreens, and related products for CSA members, retail customers, and wholesale buyers.
2. Eligibility
You must be at least 18 years old to create an account, sign up for a CSA membership, or make a purchase. By using our services, you represent that you meet this age requirement and that all information you provide is accurate and truthful.
3. Account Registration
Some of our services require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. We use a passwordless magic-link sign-in system. If you believe your account has been compromised, contact us immediately.
4. Products and Services
4.1 Online Shop
The online shop sells fresh produce, mushrooms, microgreens, honey, and related products. All items are subject to availability. We reserve the right to refuse or cancel any order at our discretion, in which case we will refund the full amount charged.
4.2 CSA Memberships
CSA (Community Supported Agriculture) memberships are governed by our Membership Agreement, which is incorporated into these Terms by reference. Key provisions:
- The 20-week CSA season runs June 23 through November 3, 2026
- Pickups occur at 5 Chestnut Hill Rd, Southborough MA on Thursdays and Saturdays, 8 AM – 12 PM
- Missed pickups are not refunded except in documented cases of farm closure
- Weather, crop failure, or other unforeseen events may affect share contents
4.3 Gift Memberships
Gift memberships may be purchased for delivery to a recipient. Gift codes expire on November 3 of the applicable season year if unredeemed. Gift purchases are non-refundable once the gift notification has been delivered to the recipient.
4.4 Pricing and Availability
All prices are in US dollars. We reserve the right to change prices at any time, but changes will not affect orders or memberships already placed. Offers, discounts, and promotions are subject to the specific terms stated at the time of the offer.
5. Payment
We accept credit and debit cards (via Stripe), Venmo, ACH transfers, and Zelle. For online payments, Stripe processes all card data; we do not store full card numbers on our servers. Offline payment methods (Venmo, ACH, Zelle) receive a 4% discount and require verification before membership activation.
By selecting the split-payment option for a CSA membership, you authorize us to charge the second installment automatically to the saved payment method on the due date. Details of split-payment terms are in the Membership Agreement.
6. Refunds and Cancellations
Refund and cancellation terms are described in our Refund Policy. In summary:
- Shop orders are non-refundable once harvested and prepared for pickup, except in cases of product defect or farm error
- CSA memberships may be cancelled within 14 days of signup for a full refund, less any pickups already received
- Gift memberships are non-refundable once the recipient has been notified
7. Pickup and Missed Pickups
Customers are responsible for picking up their orders and CSA shares during the stated pickup windows. Perishable items not picked up will be donated or composted and will not be refunded or rescheduled. If you anticipate missing a pickup, contact us at least 24 hours in advance to discuss options.
8. Acceptable Use
You agree not to:
- Use the site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to our systems, accounts, or data
- Interfere with or disrupt the site’s operation
- Submit false, misleading, or fraudulent information
- Resell our products without written permission
9. Intellectual Property
All content on this website — including text, images, logos, branding, and design — is the property of Grafted Roots Farms LLC or our licensors and is protected by copyright and trademark laws. You may not copy, reproduce, or redistribute our content without prior written permission.
10. Third-Party Services
Our site integrates with third-party services including Stripe (payments), Supabase (hosting/database), Resend (email), Netlify (hosting), and Google Analytics. Your use of these services is governed by their own terms and privacy policies.
11. Disclaimer of Warranties
Our products are grown using organic practices but are not USDA certified organic. We do not guarantee that any specific crop will be available in any given week. Share contents vary based on harvest, weather, and season. The website is provided “as is” without warranties of any kind, express or implied.
12. Limitation of Liability
To the maximum extent permitted by law, Grafted Roots Farms LLC, its owners, employees, and partners shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the site or our products. Our total liability for any claim related to your membership or orders is limited to the amount you paid to us in the 12 months preceding the claim.
13. Food Allergies and Safety
We grow and pack produce on a farm where nuts, dairy, gluten, and other common allergens may be present in adjacent products. We are not a certified allergen-free facility. Customers with severe allergies should exercise caution and contact us with specific concerns.
14. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the site shall be resolved in the state or federal courts located in Worcester County, Massachusetts.
15. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent changes. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
